4. Preventing Sexual Harassment in the Workplace
What is Sexual Harassment? Similar to harassment, sexual harassment is unwanted conduct of a sexual nature that has the purpose or effect of violating a person’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment. Discrimination law also recognises sexual harassment as something separate to sex (i.e. female or male) harassment. Sexual harassment is different from sex harassment. Sex harassment is conduct related to someone’s gender whereas sexual harassment is conduct of a sexual nature irrespective of their gender and/or when someone receives less favourable treatment because an employee subjects to or rejects unwanted conduct of a sexual nature i.e. a manager refused to give an employee a pay rise because they had previously rejected the managers sexual propositions.
